Terms of Service

Edmonton Home Team is a collaboration between two independent, licensed professionals: Josh Tagg, a mortgage broker with Indi Mortgage (a licensed mortgage brokerage in the Province of Alberta), and Jay Lewis, a REALTOR® with RE/MAX Excellence. Both are regulated in Alberta by the Real Estate Council of Alberta (RECA). “Edmonton Home Team” is a collaborative brand only — it is not itself a brokerage or a licensed real-estate team.

These Terms of Service (the “Terms”) govern your access to and use of our website, online mortgage calculators and tools, rate and market information, registration and booking forms, and related services (together, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Not advice & estimates only

Please read this carefully. All content on this website — including articles, market and rate information, calculators, and other tools — is provided for general information purposes only. It is not financial, legal, tax, mortgage, or real-estate advice, and it does not take your personal circumstances into account.

Any rates, payments, amounts, prices, or results shown are estimates, not offers or commitments to lend or to buy or sell. Actual mortgage rates, terms, and approval are determined by the applicable lender and are always subject to lender approval, credit review, income and asset verification, property appraisal, and other conditions. Advertised or displayed rates can change at any time without notice and may not be available to you. Nothing on this website creates a lending, agency, or client relationship or obligates any lender, brokerage, or professional to provide financing or services. For advice specific to your situation, please speak with Josh (mortgage) or Jay (real estate) directly.

Online tools & calculators

Our calculators and other online tools are provided to help you explore general scenarios. Results depend on the information you enter and on assumptions built into the tools, and they may not reflect current rates, program rules, fees, taxes, or your actual qualifications. We do not guarantee that any result is accurate, complete, or current, and no result constitutes a quote, pre-approval, or commitment to lend. You should not rely on any tool output as the basis for a financial decision without confirming the details with a licensed professional.

How we use your phone number

We will send you text messages, both manually and via automation, when you sign up for services from us. Examples of sign-ups include:

• starting or submitting a mortgage application;
• registering for an informational webinar; and
• scheduling an appointment with either of us.

You can cancel the SMS service at any time. Simply text “STOP” to the number sending you the message. After you send “STOP,” we will confirm your unsubscribe status via SMS, and you will no longer receive SMS messages from us. To rejoin, sign up as you did initially and we will resume sending SMS messages to you.

If you experience issues with the messaging program, reply with the keyword “HELP” for more assistance, or reach out directly to [email protected]. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply, and message frequency varies. For questions about your text or data plan, contact your wireless provider. For privacy-related inquiries, please refer to our Privacy Policy.

Third-party services & links

The Services may contain links to, or integrations with, third-party websites, portals, and applications — including lenders, application portals, Finmo, appointment and document-collection tools, our webinar and intake forms, and Jay’s property-search tools (for example, jaysells.ca). These third parties are independent of us.

We provide these links and integrations for convenience only. We do not control and are not responsible for the content, accuracy, security, availability, or practices of any third-party service, and a link does not imply our endorsement. Your use of any third-party service is governed by that provider’s own terms and privacy policy, which we encourage you to review. Any dealings you have with a third party are solely between you and that third party.

Accounts & portals

Some Services let you create an account or log in to a portal to submit an application, upload documents, or track your file. If you use an account, you are responsible for keeping your login credentials confidential and secure, for all activity that occurs under your account, and for notifying us promptly if you believe your account has been accessed without your authorization. You agree to provide accurate, current, and complete information and to keep it up to date. We are not liable for loss arising from unauthorized use of your account that results from your failure to safeguard your credentials.

Acceptable use

When using the Services, you agree not to:

• scrape, harvest, crawl, or use automated means to extract data from the site or any portal;
• access, or attempt to access, any account, system, or data you are not authorized to access;
• interfere with, disrupt, overload, or attempt to compromise the security or integrity of the Services;
• introduce malware or any harmful code;
• use the Services for any unlawful, fraudulent, or misleading purpose, or to submit false information; or
• copy, resell, or otherwise misuse the Services or any content in a way not permitted by these Terms.

We may suspend or terminate access to the Services for any user who violates these Terms.

Intellectual property

All content on this website — including text, graphics, logos, branding, calculators and tools, layout, and design — is owned by or licensed to the Edmonton Home Team collaborators (Indi Mortgage and RE/MAX Excellence, as applicable) and is protected by copyright, trademark, and other laws. RE/MAX and REALTOR® marks are the property of their respective owners. You may view and use the content for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any part of the Services without our prior written permission.

Disclaimer of warranties

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including any warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any content, rate, or calculation is accurate or current.

Limitation of liability

To the fullest extent permitted by law, the Edmonton Home Team collaborators and their respective brokerages, owners, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Services, your reliance on any content, rate, or calculator result, or your use of any third-party service — even if we have been advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability arising from or relating to the Services is limited to CAD $100. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

Governing law & jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that the courts located in Alberta, Canada will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “last updated” date above, and the updated Terms take effect when posted. Your continued use of the Services after changes are posted means you accept the revised Terms.
