Edmonton Home Team is a collaboration between two independent, licensed professionals — Josh Tagg, a mortgage broker with Indi Mortgage, and Jay Lewis, a REALTOR® with RE/MAX Excellence (together, “we”, “us” and similar pronouns). We are committed to maintaining the accuracy, security and privacy of the personal information submitted to us by our clients and others with whom we do business (“you”), in accordance with applicable legislation. This Privacy Policy is a statement of the principles and guidelines we apply with respect to your personal information.

Because two independent professionals are involved, personal information you provide for mortgage services is handled by Josh Tagg under the privacy practices of Indi Mortgage, and personal information you provide for real-estate services is handled by Jay Lewis under the privacy practices of RE/MAX Excellence. Each of us is regulated in Alberta by the Real Estate Council of Alberta (RECA). “Edmonton Home Team” is a collaborative brand only; it is not itself a brokerage or a licensed team.

Consent

By submitting personal information to the Edmonton Home Team, or to either of us or our associates or staff, you agree that we may collect, use and disclose such personal information in accordance with this Privacy Policy and as permitted or required by law.

You may refuse or withdraw your consent at any time by contacting our Privacy Officer (below). If you refuse or withdraw your consent, we may not be able to provide, or continue to provide, our services to you. Unless you specifically advise us otherwise in writing at the time, we will rely on your representation that you have all necessary authority and/or have obtained all necessary consents to enable us to collect, use and disclose any personal information of another individual that you provide to us, for all purposes permitted by this Privacy Policy.

What personal information do we collect?

Alberta and Canadian privacy legislation define “personal information” very broadly — generally, information about an identifiable individual, or that allows an individual to be identified, and that is not already “public” under exceptions in the applicable legislation. In this policy, “personal information” means information defined as personal information under applicable Alberta or Canadian privacy legislation and not exempted under it.

Depending on which services you use, we may collect your name, home address, telephone number and personal email address; income, employment, asset, liability and net-worth information; and other information necessary in connection with a mortgage application, pre-approval or request for information (including information about family members, guarantors and other relevant parties). For real-estate services, we may also collect your property preferences, search criteria, and information needed to prepare, present or complete an offer or transaction.

When you communicate with us through online forms and registration forms, we may collect the information you submit (such as your email address) and, through analytics tools, general information about how visitors use our website. We use this information to improve our website and to contact visitors about the services they enquired about. Cookies may be used to remember your preferences and improve your experience. Why do we collect your personal information?

As financial-services and real-estate professionals, we have professional obligations to keep information we receive in confidence, and nothing in this Privacy Policy is intended to limit those obligations. In general, we collect, use and disclose personal information in order to provide you with mortgage brokerage services, real-estate services, and related services, including some or all of the following:

• providing mortgage brokerage services — arranging and/or renewing mortgage financing, and informing you of products offered or approved by lenders or other parties with whom we have business relationships that may be of interest to you;
• providing real-estate services — helping you search for, evaluate, offer on, buy or sell a property;
• checking your credit-worthiness through credit-bureau inquiries and personal-information agents (mortgage services);
• advising you of your options and of developments in the mortgage and real-estate markets;
• auditing the services provided to our clients;
• complying with all municipal, provincial, federal and other applicable laws; and
• any specific purpose communicated to you before collection, or to which you consent.

Except when otherwise permitted by law, we will only use your personal information for the purposes identified to you. If personal information is to be used for a new purpose, we will take reasonable steps to identify that purpose and obtain your consent before such use.

To whom do we disclose your personal information?

From time to time we may disclose your personal information to:

• prospective lenders, financial institutions, insurance companies and other suppliers of products or services we are providing or offering to you;
• other real-estate brokerages, agents, and parties to a transaction, where needed to present or complete an offer;
• staff, sub-brokers and affiliated brokerages, for purposes related to the services we are providing to you;
• service providers we have retained to perform functions on our behalf (for example, office, registry, document-collection and appointment tools);
• organizations or individuals retained to evaluate your creditworthiness or collect outstanding debts;
• a person who, in our reasonable judgment, is acting as your agent or is otherwise legally entitled to the information;
• police or other authorities where, in our opinion, disclosure is required to protect the public interest, including suspected fraud or money laundering;
• law firms retained to act on our behalf; our insurers; and regulatory agencies such as RECA in connection with our regulatory obligations; or
• any third party where you consent, or where disclosure is required or permitted by law.

Because much of our work with lenders and other parties is conducted electronically, you consent to our transmission of your personal information by electronic means, including email, for the purposes identified in this policy or otherwise consented to by you.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use-case categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

Where do we store your personal information?

Your personal information is stored in secured locations and on computers and servers controlled by us or our respective brokerages, and with the reputable service providers we use to deliver our services. We employ safeguards appropriate to the sensitivity of the information.

How may you access your personal information?

Upon your written request, we will inform you of the existence, use and disclosure of the personal information we hold about you, and give you access to it, subject to applicable legal exceptions. Access requests should be sent to our Privacy Officer using the contact information below.

How do we protect your personal information?

To help protect the confidentiality of your personal information, we employ administrative and technological safeguards appropriate to its sensitivity, and we endeavour to operate secure data networks protected by industry-standard firewall and password-protection systems. While the safeguards used by third parties are established by those third parties, we will not knowingly continue to deal with a third party where we have actual notice of a failure to adequately protect your personal information.

Use of IP addresses and cookies

An IP address is a number automatically assigned to your device when you use the Internet. Our web servers may log visitors’ IP addresses for system administration, to report aggregate information, and to audit the use of our site. We do not normally link IP addresses to anything personally identifiable — your session is logged, but you remain anonymous to us — though we may use IP addresses to identify a user where necessary to enforce our terms or protect our site, our clients, or others.

Cookies are small pieces of information a website transfers to your device for record-keeping. They make browsing easier by remembering your preferences, and they help us understand which areas of the site are useful so we can improve them. The use of cookies is an industry standard. Most browsers are initially set to accept cookies; you can reset your browser to refuse cookies or to alert you when one is being sent. Information gathered through cookies is compiled on an aggregate, anonymous basis and is not used to gather personal information such as your name or email address.

Property search and listing information for the real-estate side of our services is provided through Jay Lewis / RE/MAX Excellence and third-party listing platforms. Listing data is deemed reliable but is not guaranteed accurate by the REALTORS® Association of Edmonton. The trademarks REALTOR®, REALTORS® and the REALTOR® logo are controlled by The Canadian Real Estate Association (CREA) and identify real-estate professionals who are members of CREA. The trademarks MLS®, Multiple Listing Service® and associated logos are owned by CREA and identify the quality of services provided by real-estate professionals who are members of CREA.

Changes to this Privacy Policy

We reserve the right to modify or supplement this Privacy Policy at any time. If we make a change, we will post it on this website (edmontonhome.team/privacy) and make the revised policy available on request.
